Terms & Conditions for Orders and Membership

1. Who we are

Tone District is a trading name of TONEDISTRIC LTD.

Registered in England and Wales, company number 08208277. Registered office: GF2, 5 High Street, Westbury on Trym, Bristol BS9 3BY, United Kingdom.

The registered office is an administrative address only. It is not a shop, it does not hold stock, and nothing should be sent there.

2. Your rights when you buy from us

If you are a consumer, the Consumer Rights Act 2015 applies to everything you buy from us. Goods must be:

  • of satisfactory quality — meeting the standard a reasonable person would expect, taking account of price and description;
  • fit for purpose — including any particular purpose you told us about before buying;
  • as described — matching the description, sample or model you were shown.

Services, including workshop repairs, must be carried out with reasonable care and skill, within a reasonable time, and for a reasonable price where no price was agreed.

If goods do not meet these standards you have a short-term right to reject within 30 days, and after that a right to repair or replacement, and to a price reduction or final right to reject if that fails.

We do not exclude any of these terms. Any earlier wording suggesting otherwise does not apply.

Business customers: the Sale of Goods Act 1979 and the Supply of Goods and Services Act 1982 apply, and the terms of sale set out the position between us.

3. Placing an order

Adding items to your basket and paying is an offer to buy. A contract is formed when we send you a dispatch confirmation, not when you receive the automatic order acknowledgement.

We may decline an order — for example if the item is out of stock, if we have identified a pricing error, if we cannot verify payment, or if we cannot lawfully ship it to your address. If we decline an order you have paid for, we refund in full.

4. Price

The price is the one shown on the product page at the time you order, including VAT where applicable.

We will not increase the price after we have accepted your order. If a listed price was clearly wrong — a decimal in the wrong place, an instrument at a fraction of its value — we will contact you before dispatch and give you the choice of paying the correct price or cancelling for a full refund. We will not take the difference without asking.

Delivery to the UK and the US is free. Import duty on US orders is dealt with on the shipping page.

5. Availability and substitution

We will not substitute a different product for the one you ordered without your agreement.

If what you ordered is unavailable or has been discontinued, we will contact you, tell you what we can offer instead, and cancel and refund in full if the alternative is not what you want.

Individual instruments vary. Grain, figuring and shade differ between examples of the same model, and photographs on a listing may be of a representative example rather than the exact instrument. Where a listing shows a specific instrument, that is the instrument you will get. If you want to see photographs of the actual one before it ships, ask.

6. Payment

We take payment when you order. Card details are handled by our payment provider; we do not hold your card number.

Where you pay by instalment plan or finance, the provider's terms apply in addition to these. See the finance page.

If a payment is reversed or charged back after dispatch, we may recover the goods or the amount owed.

7. Delivery, risk and title

Delivery times are on the shipping page.

Goods are at our risk until they are delivered to the address you gave us. Title passes to you when we have received payment in full.

We will deliver within 30 days of the contract unless we have agreed something else with you. If we miss an agreed delivery date that was essential, or fail to deliver within a further reasonable period, you may cancel and get a refund.

8. Cancellation and returns

Your cancellation and return rights are set out in full in the refund policy. We give 30 days, which is longer than the 14 days required by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

There is no restocking or administration fee on a lawful cancellation.

9. Accounts

You do not need an account to order, but you can create one to track orders and save addresses.

Keep your password to yourself. Tell us if you think someone else has access to your account. You are responsible for activity on your account unless it results from our failure.

We may suspend or close an account that is being used fraudulently or in breach of these terms. If we close your account, it does not affect orders already accepted.

We do not run a paid membership or subscription scheme.

10. Waste Electrical and Electronic Equipment (WEEE)

The WEEE Regulations mean electrical equipment should not go in ordinary household waste, and that retailers must help customers dispose of old equipment.

What is covered: amplifiers, powered speakers, effects pedals, multi-effects units, power supplies, electronic tuners and metronomes, audio interfaces, electronic drum modules, headphones, and other equipment that runs on mains power or batteries.

What is not: a passive electric guitar or bass with no active electronics is not WEEE. Neither is an acoustic guitar, a set of strings or a gig bag.

What we offer. When you buy a new item of electrical equipment from us, we will take back your old equivalent item free of charge for correct disposal, on a like-for-like basis. Bring it to the showroom, or ask about it when you order.

This applies to UK sales. Customers in the United States should check local electrical recycling arrangements, which differ by state.

11. Intellectual property

The Tone District name, logo, site design, photographs and written content are ours and are protected by copyright and trade mark law. You may not reproduce them commercially without our written permission.

Brand names and logos belonging to manufacturers are the property of those manufacturers and are used to identify the products we sell.

12. Events outside our control

We are not liable for failure or delay in performing our obligations where it is caused by something beyond our reasonable control — including supplier failure, courier disruption, extreme weather, fire, flood, power failure, industrial action or government restrictions.

If such an event occurs we will contact you and either extend the delivery time or, if the delay is substantial, let you cancel and refund you in full.

14. Governing law

These terms are governed by the law of England and Wales. If you are a consumer resident in the United States, this does not deprive you of the protection of mandatory provisions of your state's law.

15. Changes

We may change these terms. Changes take effect when posted here and do not apply to orders already accepted.
