Terms of sale

These terms govern the sale of goods and services by Tone District, whether you buy online, by phone or in the showroom. Nothing in them affects your statutory rights.

1. The seller

Tone District is a trading name of TONEDISTRIC LTD.

Registered in England and Wales, company number 08208277. Registered office: GF2, 5 High Street, Westbury on Trym, Bristol BS9 3BY, United Kingdom.

The registered office is an administrative address only. It is not a shop, it does not hold stock, and nothing should be sent there.

2. How the contract is formed

Online and by phone. Your order is an offer to buy. We accept it when we send you a dispatch confirmation. The automated order acknowledgement is not acceptance.

In the showroom. The contract is formed when you pay.

If we cannot accept your order we will tell you and refund any payment in full.

3. Description of goods

We describe goods as accurately as we can. Photographs and specifications are a guide.

Wood is not uniform. Grain, figuring and shade vary between individual instruments of the same model, and screen calibration varies between devices. These variations are not defects.

Pre-owned instruments are described including their faults. Where a listing describes wear, marks or previous repair, that is part of the description and is not a basis for a claim that the goods are not as described.

Where a listing shows a specific instrument, that instrument is what you will receive. Ask for photographs of the actual item if you want them before it ships.

4. Price

The price is the one displayed at the time you order, in pounds sterling for UK orders and in the currency shown at checkout for US orders. VAT is included where it applies.

We will not increase the price after we have accepted your order. Where a price was obviously wrong, we will contact you before dispatch and offer you the correct price or a full refund. We will not charge the difference without your agreement.

Delivery to the UK and the US is free.

5. Import duty and taxes on US orders

Goods sent to the United States are subject to US import duty and taxes. The US $800 de minimis exemption was suspended in August 2025.

We pay: US prices include import duty and taxes. Nothing further is payable on delivery.

6. Payment

Payment is due in full at the time of order. We accept the methods listed on the finance page.

We do not receive or store your full card number.

Where payment is by instalment plan or finance agreement, the provider's terms apply in addition to these, and the goods remain subject to clause 8 until we have received payment in full.

7. Delivery

Delivery times are on the shipping page: 1–2 working days processing, 3–5 working days in transit.

Times are estimates. Where we are unable to meet an agreed delivery date that you told us was essential, or fail to deliver within a further reasonable period, you may cancel and receive a full refund.

We deliver within 30 days of the contract unless we have agreed otherwise with you.

8. Risk and title

Risk in the goods passes to you on delivery to the address you gave us, or on collection from the showroom.

Title passes when we have received payment in full for the goods, including where payment is being made through a finance agreement and the provider has settled with us.

9. Cancellation and returns

Your rights are set out in full in the refund policy.

In summary: 30 days from delivery to tell us you are returning something, 14 further days to send it, goods to come back complete and undamaged, and a refund within 14 days of us receiving them. Change-of-mind return postage is at your cost; faulty or wrongly supplied goods are at ours.

We do not charge a restocking or administration fee on a lawful cancellation.

10. Faulty goods

Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described.

If they are not, you have a right to reject them within 30 days of delivery and receive a full refund. After 30 days you are entitled to a repair or replacement, and if that fails or is not possible, to a price reduction or a final right to reject.

Manufacturer warranties run alongside these rights. We handle warranty claims on your behalf. Being outside a warranty period does not necessarily mean you are outside your rights against us.

Fair wear and tear is not a fault. Nor is damage from misuse, accident, unauthorised modification, or storage in unsuitable humidity.

11. Services

Workshop services are supplied under the Consumer Rights Act 2015: with reasonable care and skill, within a reasonable time, and for a reasonable price where none was agreed.

We quote before work starts and do not exceed a quote without your agreement. If the work turns up something we could not reasonably have seen at the quoting stage, we stop and speak to you.

Instruments left with us remain your property. We insure customer instruments in our care 

Instruments not collected within 30 days of us telling you the work is complete may be subject to storage charges, and after 30 days we may exercise a lien and sell the instrument to recover what is owed, accounting to you for any surplus. Take legal advice on this clause before publishing it.

12. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of the statutory terms about quality, fitness and description, for defective products under the Consumer Protection Act 1987, or for anything else that cannot lawfully be excluded.

Subject to that, we are not liable for losses that were not foreseeable when the contract was formed. If you are a consumer, we are not liable for business losses. Where we are liable and the carve-outs above do not apply, our liability is limited to the price of the goods.

13. Events outside our control

We are not liable for delay or failure caused by events beyond our reasonable control. If such an event occurs we will contact you and extend the delivery time, or let you cancel for a full refund if the delay is substantial.

14. Governing law

These terms are governed by the law of England and Wales. UK consumers may bring proceedings in England and Wales, or in Scotland or Northern Ireland if resident there. US consumers retain the protection of any mandatory provisions of their state's law.
